DAVID A. GENELLY
During more than 35 years of practicing law, DAVID A. GENELLY has devoted his practice to general business law, specifically securities, futures, derivatives regulation and litigation, banking, insurance, antitrust, UCC matters and commercial contract disputes. David litigates and arbitrates disputes across the country, including in federal district and appellate courts, state trial and appellate courts, administrative agencies and self-regulatory organizations. David has tried to judgment numerous cases in various forums. These matters range from patent license cases, complicated bankruptcy matters, securities disputes, manufacturing, futures industry claims, contract and UCC matters, tax claims, False Claim cases, derivative actions, receiverships and mergers and acquisitions. He has been lead counsel in various class actions and has served as a receiver in Federal Court. He has argued numerous appeals in the Seventh Circuit, District of Columbia Circuit, Second Circuit and Federal Circuit Courts of Appeal, as well as Appellate Courts in various states.
David has substantial experience representing individuals and corporate clients before various arbitration forums, including matters before the Financial Industry Regulatory Authority (“FINRA”) and the National Futures Association (“NFA”). He has also served as an arbitrator for these organizations as well as with the Cook County Court Illinois Arbitration System. A list of his cases is available upon request.
David represents various securities industry broker-dealers, investment advisors, hedge funds, market makers, registered representatives, futures commission merchants, broker associations, introducing brokers and others in regulatory enforcement actions before the Securities and Exchange Commission (“SEC”), NFA, NASD and state securities agencies charged with regulating Blue Sky laws, as well as various exchanges including the Chicago Mercantile Exchange, Chicago Board of Trade, Chicago Board Options Exchange and the Chicago Stock Exchange. David also counsels and provides transactional services to various clients with general business issues and capital formation matters. These activities include new business formation and capital raising through various private placement offerings. In addition to being a member of the Illinois Bar, David is a member of the Trial Bar of the United States District Court for the Northern District of Illinois, and various United States Courts of Appeal including the Seventh, Second, and Federal Circuits. He is a member of the Chicago Bar Association and is a member of the Futures Industry Association (Law and Compliance Division). David lectures and circulates various industry workshops while also contributing to professional periodicals in various business fields. He has been a guest speaker at various securities industry regulatory conferences across the country.
David has achieved the peer review AV ranking by the American Registry Division of Martindale Hubbell (less than 15% of all attorneys achieve this rating), and has been chosen for inclusion in the Super Lawyers roster of top attorneys in business law for a number of years.
David is a graduate of Loyola University of Chicago (B.A. with Honors, summa cum laude, 1974) and Georgetown University (J.D., Deans List, 1977). While at Georgetown, David was on staff and later editor of Law & Policy in International Business, a journal of Georgetown University Law Center.
